Terms and conditions for Landlord-Law Online kits

NB These terms and conditions do not affect your statutory rights.

General

These terms and conditions relate to the Landlord-Law Kit online courses, which are delivered via the TJ Shepperson ‘Moodle’ training web-site at www.housinglawtraining.com. Your use of the kits and this web-site is subject to your agreement to these terms and conditions. Please read them carefully.

1. We are Landlord-Law (LL), an online legal service provided by TJ Shepperson solicitors of 148 Unthank Road, Norwich, Norfolk NR2 2RS, UK. TJ Shepperson is regulated by the Solicitors Regulation Authority.

2. You are a person wishing to purchase access to one of our Online Kits. When enrolled on the course you will be described as a student.

3. The Landlord-Law Online Kits consist of written information and legal material relating to the subject matter of the kit, e.g.: instructions, documents, letters, and forms together with an online discussion forum where you can ask questions of the instructor.

4. After enrolment students will have access to all course material and the forum for a period of 186 days (six months). Further access to the online kit course after this can be purchased by agreement.

5. The Kits are only suitable for use in connection with property in England and Wales in the United Kingdom (UK) and do not cover the law in other jurisdictions. However, as the courses are delivered online, students can access the kit courses from outside the UK.

6. Payment: All kit courses must be paid for in full in advance.

7. Confirmation of booking: This will be sent to you by email at the email address provided to us within 5 days of receipt of payment . A VAT receipt will normally also be sent via post provided an address is provided which is in England and Wales.

8. Cancellations: LL reserves the right to vary or cancel one of the kit courses where the occasion necessitates. LL accept no liability if, for whatever reason, the kit course is withdrawn. Full refunds to prospective students of any fees paid for courses will be made in the event of cancellation by LL. If the course is withdrawn or cancelled during a students period of access, a proportionate part of the course fee will be refunded.

9. Prices: These may be subject to change. However you will not be affected by any price increase after you have made your purchase.

10. Cancellations: All kit purchases can be cancelled without penalty prior to enrolment on the course. No refunds can be made after enrolment.

11. Transfers: If after payment you find you have booked a place on the wrong course, you can transfer your booking to one of the other online kits, provided this is done prior to enrolment on the course.

12. Telephone advice: After you have enrolled on the kit course, you will be able to claim up to ½ hour telephone advice, which shall be provided in one telephone call, which shall be made by you (ie you bear the cost). Information on how this can be claimed is available on the kit web-site. The advice shall be provided not less than seven days after receipt by us of a written request by email.

13. If during the telephone advice call we learn that your opponent is an existing client of TJ Shepperson solicitors, we will have a conflict of interest and will not be able to provide any telephone advice regarding that claim, although we may still be able to provide case neutral advice regarding the completion of the forms and general procedures. If we are unable to provide telephone advice due to a conflict of interest, you will be entitled to a refund of £30 (inclusive of VAT), which will be in full and final settlement of any claim you may have in that regard.

14. Liability: So far as the law allows, neither LL nor the Kit instructors will be liable, by reason of breach of contract, negligence or otherwise, for any loss occasioned to any person acting, omitting to act or refraining from acting in reliance upon the kit course material or presentation of the course material or presentation of the course, except for losses arising from or connected with any error in the course material or its presentation, in which case liability will be limited to the course fee paid.

15. Your responsibilities: You agree that you will use the online kit service responsibly and in good faith, and that we may terminate your access to on any kit course without notice if you do not. We would draw your attention in particular to the following situations:

      15.1. If your course fee is not paid by your bank or credit card company

      15.2. If you allow other unauthorised people to use your user-name and password to access and use the kit online training service

      15.3. If you copy or otherwise reproduce any course material or any of the material on the kit training site, particularly if you publish this for payment and/or if it results in misleading, derogatory or inaccurate representation of LL material

      15.4. If you post any defamatory or offensive material on any of the LL discussion forums or wiki

16. Access: To enable you to access any course you will be provided with a username and password and an enrolment key (which you will need when you first access - or enrol on - the kit course). You agree to keep these confidential and not allow anyone else to use them.

17. It is your responsibility to ensure that your computer equipment and software are capable of accessing the LL training web-site and, receiving and using the LL online training service. We cannot be responsible for any problems you may encounter using the system. Due to the nature of interactive Internet services, we cannot guarantee that your use of the LL online training service will be free from interruption or errors.

18. Copyright: You acknowledge that the ownership and legal title and all intellectual property rights in any part of the content of an LL course are either vested in LL or are as described in the individual document or article

19. Data Protection: LL may periodically contact you with details of programmes and services that may be of interest to you. Please write to the LL if you wish your name to be removed from the mailing list. Under the Data Protection Act you may request details of personal information we hold about you. Please send any such requests to us at 148 Unthank Road, Norwich, Norfolk NR2 2RS or by email to info@landlordlaw.co.uk. We reserve the right to charge an administration fee for this not exceeding £5.00 at our discretion. If you believe that any information we hold about you is incorrect or incomplete, we will amend our records upon being informed of this by you.

20. Complaints: If you have any complaint about our service, please contact Tessa Shepperson by email at info@landlordlaw.co.uk. We will endeavour to respond to complaints within five working days.

21. Jurisdiction: Your agreement with LL and these terms and conditions shall be subject to and governed by the law of England and Wales
